Law and Safety
Hi guys!
I'm new to this group and to the safety community. I am a Paralegal at a Defense Law Firm and have been practicing law for 20 years. Our practice involves quite a bit of construction defect cases. I started to notice a trend in our cases where employees or subcontractors would fall from a roof or through a hole that was not properly covered, or because they weren't wearing PPE. We usually hire OSHA experts to review file material and give feedback on standards or their "expert" opinion on the accident details. I don't know if you've ever had to hire an OSHA Expert, but just like any other Expert, it can be costly. Very costly, depending on the case. So I decided about a year ago to start looking into the training that our OSHA Experts had listed on their CV. Since then I have completed 6 different safety for construction certification courses and very recently completed the OSHA 10 Outreach Training. The courses helped alot as far as my understanding of what could have been done to prevent the accident in the first place. There's so much more for me to learn and I appreciate the chance to be part of this group!

Thanks for the information Mike Hinson and Eric Henricks.
Branden, our Worker's Comp division is dealing with COVID claims that family members are making on behalf of their spouse, parent or child due to getting sick at their work place. These are hard cases to prove because they could've come into contact with it anywhere and not necessarily at work. Our Worker's Comp Legal team is starting to investigate the claims and also the legal responsibility of Employers as it relates to COVID. This is where OSHA comes in I believe. I know they recently updated their information relating to standards or requirements. I know they're also looking into this. I have some information on this and will post about it soon.
Thanks again gentlemen for the information. Appreciate it. Keep it coming!

Welcome to the community!! Have you had to deal with any Covid Litigation cases yet? If yes, are you able to make some general comments on what happened and results?

Glad you made it! The people here are super helpful so ask away.
Helpful interpretations are also available in the interpretation letters that OSHA (and other agencies) publish. Web searches will find them.
The injury trend you mention is unfortunate and 100% preventable. On the bright side, all of the training you have taken is applicable in your own home and I’m sure will decrease risk of accidents on your own property .

OSHA.gov you can go there click the menu tab then you can type in your question in the search bar and it will bring up the OSHA standard on what your trying to find for example type in CFR 1929 fall protection or you can use scaffolding just put CFR or 1910 in front your question you can also use the A to Z search and read every standard OSHA has for that craft I hope this helps you
